These terms govern your use of Atemstark Academy at academy.atemstark.com (the "Academy"), operated by Michael Schnekenburger ("Atemstark"), Zurich, Switzerland. By creating an account you agree to these terms. Our general company-wide Terms of Use are available at https://atemstark.com/terms/ and apply in addition to this notice.
1. Account
You are responsible for keeping your login credentials confidential. Accounts are personal and non-transferable. We may suspend or terminate accounts that violate these terms or applicable law.
2. Content and intellectual property
All course videos, audio, PDFs, exercises, and written material on the Academy are the intellectual property of Atemstark and protected by copyright. You receive a personal, non-exclusive, non-transferable, revocable license to access and use the content for your own personal practice. You may not download, copy, redistribute, republish, mirror, screen-record, or share the content with third parties.
3. Purchases and refunds
Course purchases are governed by the Terms of Purchase shown at checkout, including our 14-day refund policy. Please review them before buying.
4. Health disclaimer
Breathwork can produce strong physiological effects. Atemstark Academy content is for educational purposes and is not medical advice, diagnosis, or treatment. Do not practice breath holds or intense breathing exercises while driving, swimming, in or near water, or operating machinery. Consult a qualified physician before participating if you have cardiovascular, pulmonary, neurological, psychiatric, or other serious medical conditions, a history of fainting or seizures, are pregnant, or have recently had surgery. You participate at your own risk.
5. Acceptable use
You agree not to use the Academy to upload unlawful, harmful, or infringing content; to attempt to disrupt the platform; or to misuse other users' data. Reviews and comments must remain respectful.
6. Third-party services
The Academy is hosted on Thinkific Labs Inc. Payments are processed by Stripe / Thinkific Payments. Their terms apply to the respective services.
7. Limitation of liability
To the maximum extent permitted by Swiss law, Atemstark is not liable for indirect, incidental, or consequential damages arising from your use of the Academy. Nothing in these terms excludes liability for gross negligence or intent.
8. Changes
We may update these terms. Material changes will be communicated by email or via this page; the "last updated" date will reflect the change.
9. Governing law and jurisdiction
These terms are governed by Swiss law. Exclusive place of jurisdiction is Zurich, Switzerland, subject to mandatory consumer-protection rules of your country of residence.
